Terms of Service
These Terms govern access to ChurchAudioAI, subscriptions, metered voice usage, live translation, and related services.

1. Agreement and provider
These Terms are a binding agreement between Devoted Action LLC, a Minnesota limited liability company (Minnesota file no. 1655411200025) (“Devoted Action,” “we,” “us”) and the person or organization using ChurchAudioAI (“Customer,” “you”). By creating an account, accepting a Checkout prompt, or using the service, you accept these Terms, the Privacy Policy, Refund and Cancellation Policy, Acceptable Use Policy, Voice and Biometric Data Consent, and any order details shown at purchase.
You represent that you are at least 18 years old and have authority to bind the church, ministry, company, or other organization named in the account.
2. Service and AI limitations
ChurchAudioAI provides automated speech recognition, machine translation, subtitles, synthetic or cloned speech, listener delivery, and optional sermon-content tools. Outputs are generated by artificial intelligence and may be delayed, incomplete, inaccurate, or inappropriate for a particular context.
The service is an accessibility and communication aid, not a certified interpreter, emergency service, theological authority, legal or medical translator, or substitute for human review. Customer is responsible for monitoring live output and stopping or correcting it when necessary.
3. Accounts and authorized users
- Keep credentials confidential and promptly revoke access for former staff.
- Provide accurate organization, contact, billing, speaker-consent, and tax information.
- Use organization roles and private host controls only for authorized personnel.
- Notify us promptly of suspected compromise or unauthorized use.
4. Subscription, trial, deposits, and metered use
A subscription pays for platform access and plan features. A separate voice deposit pays for translated audio actually generated. Unless the pricing page or order states otherwise, standard voice is billed at $0.10 per generated language-minute and premium voice at the disclosed premium rate. Each active output language is measured separately. Silence and languages with no generated audio are not charged.
The 14-day trial has no subscription charge and does not automatically become a paid subscription unless you affirmatively purchase one. Usage during a trial can require a paid voice deposit.
Paid subscriptions renew at the disclosed interval until canceled. We disclose the price, renewal cadence, and cancellation method before purchase. You authorize Stripe to charge the selected payment method for recurring fees, taxes, and expressly authorized purchases. Deposits are not automatically used to pay subscription fees.
5. Cancellation, taxes, and refunds
You may cancel a subscription through the billing portal or by contacting us. Cancellation stops future renewal and normally takes effect at the end of the paid term. Refunds, unused deposits, duplicate charges, and legally required remedies are governed by the Refund and Cancellation Policy.
Prices exclude sales, use, value-added, or similar taxes unless stated otherwise. Stripe or we may collect taxes based on the billing information supplied.
6. Customer content and speaker rights
You retain ownership of recordings, transcripts, translations, speaker materials, and other content you provide. You grant us and our subprocessors a limited license to host, process, reproduce, translate, synthesize, and transmit that content only to provide, secure, support, and improve the contracted service as described in the Privacy Policy and DPA.
You must obtain all notices, permissions, releases, licenses, and consents required from speakers, performers, staff, attendees, and rights holders. You may not clone or synthesize a person's voice without that person's informed authorization.
7. Acceptable use and intellectual property
You must comply with the Acceptable Use Policy. ChurchAudioAI software, branding, user interface, documentation, and service technology are owned by Devoted Action or its licensors. No rights are granted except the limited right to use the service during an active account.
8. Availability, changes, and suspension
We work to provide reliable service but do not guarantee uninterrupted availability or a fixed latency because browsers, networks, third-party AI services, and user devices affect performance. We may make security, provider, model, or operational changes while seeking to preserve material functionality.
We may suspend access to protect users or systems, respond to legal obligations, prevent fraud or abuse, address unpaid amounts, or investigate a material breach. When practicable, we will provide notice and an opportunity to cure.
9. Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ERROR-FREE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES OR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY CUSTOMER TO US DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where prohibited by law or to fraud, willful misconduct, or liabilities that cannot legally be limited.
10. Indemnity
Customer will defend and indemnify Devoted Action and its personnel against third-party claims arising from Customer content, unlawful voice cloning, missing permissions, Customer's violation of law, or material breach of these Terms. We will provide prompt notice and reasonable cooperation, and Customer may not settle a claim in a manner that admits fault or imposes obligations on us without consent.
11. Governing law and disputes
Minnesota law governs these Terms without regard to conflict-of-law principles. State and federal courts located in Hennepin County, Minnesota have exclusive jurisdiction, except either party may seek injunctive relief in any competent court. Before filing a claim, the parties will attempt in good faith for 30 days to resolve it by written notice.
12. Changes, notices, and contact
We may update these Terms prospectively. Material changes will be posted with a new effective date and, when required, presented for renewed acceptance. Notices may be sent to the account email.
